Conduct of the liquidation in the preceding six months
Actions taken and investigations
As stated in our first and second report we contacted the Director’s widow (Azalea Tsia nee Tiu Tai Tsai) and the Companies’ accountants and identified that Azalea Tsai had closed all operations of the Companies following the death of the director.
In spite of a number of attempts, we have been unable to talk with Azalea Tsai and can confirm that she passed away in January 2020.
We have continued our investigations into the Companies’ bank accounts, and foreign exchange service provider and raised queries with each respective bank and the foreign exchange service provider to assist with our further investigations.
Our investigations are ongoing. We have identified a number of parties that owe the Companies monies. We have sent debtor’s letters to recover funds from various parties. We have identified that significant monies have been paid to an investment fund. We are currently liaising with our legal advisors and the investment fund’s legal advisors to determine the rights to those funds.
We have conducted an investigation into any potential voidable preference payments and will continue our investigations to determine if there are any potential recoveries available from this avenue.
We have conducted interviews of parties that are able to assist in our investigations. We have liaised with the Serious Fraud Office (“SFO”), NZ Police and NZ Immigration throughout the duration of the Liquidation. Those liaisons continue.
We have been liaising with our legal advisers regarding the Estate of the Director and now the Estate of Azalea Tsai.
We have uploaded a clone of all documentation found on the companies’ computer equipment and mobile phones to an appropriate document management system. We have undertaken searches of the documentation to assist with our investigations. We have sent the computer equipment and mobile phones to Turners Auctions for sale.
Receipts and payments
BINZ Receipts for the period total $39,138 being interest and GST refunds. Payments for the period total $183,717 being legal costs, liquidator fees, RWT deducted from interest and sundry payment for administration fees. A detailed breakdown is shown in the Statement of Receipts and Payments at Appendix 1.
EWHL, EWCL, EWNCL, EWPL all had Nil receipts and payments for the period. A detailed breakdown is shown in the Statement of Receipts and Payments at Appendix 1.
JBCCL Receipts for the period total $72 being GST refund. Payments for the period total $Nil. A detailed breakdown is shown in the Statement of Receipts and Payments at Appendix 1.
